Research and Surveys

The case for FMLA technical corrections legislation has been well-documented. Solid evidence has been presented at seven Congressional hearings (summary chart; text of testimony), through a litigation explosion and through numerous surveys.

As FMLA litigation increases and implementation becomes more complex, problems associated with unscheduled and unplanned "medical" leave continue to escalate. Work coverage for questionable unscheduled absences on an intermittent basis (by hours or even minutes) has raised morale issues and has been especially challenging in industries where vital services and safety issues are at stake.
